Under no circumstances will MD Synergy Solutions, LLC (“MD Synergy”) sell, distribute or otherwise release to any third parties, Protected Health Care Information (“P.H.I.”) which uniquely or specifically identifies a health care provider and/or a patient. Furthermore, MD SYNERGY will take all steps reasonably necessary to ensure compliance in all material respects with the Health Insurance Portability and Accountability Act (“HIPAA”).

However, it is possible that MD Synergy may sell, distribute or otherwise release to third parties certain aggregate data (which is described below), and we specifically reserve the right to do so.

I. Information We Collect

We have access to the following categories of information regarding you and your visit to our web site. Only some of these categories of information identify you directly, but each category offers some information about your interests and activities that could be used to make inferences about you.

Information that You Voluntarily Provide

Site Registration: MD SYNERGY has constructed this website so that you may visit us and review information about the services we offer without revealing your identity or volunteering any personally identifying information. If you choose to register on our site, we will collect the information you may choose to disclose and analyze it to discover new facts that could help us better understand how our products are used. Upon registration, we will collect “personally identifying information” from you. “Personally identifying information” is information such as name, address, telephone number, and email address that could be used to contact you. When you begin using the site, we will collect P.H.I. that you provide, which may include the following:

a) Patient and Physician Demographics.
b) Insurance Demographics.
c) Claims submitted through our site.
d) Physician Practice Patterns (such as appointments kept, productivity, financial data and other matters relating to the business side of a physician’s practice).

Interactive Services: If you choose to participate in our interactive services such as questionnaires and surveys, you may disclose P.H.I. and/or personally identifying information as well as personal facts that could be used to identify a registered user. Registered users who use our benchmarking services and quality of care assessments may choose to disclose facts about their practice and patients that are sensitive, personal data. MD SYNERGY does not request or require you to disclose personally identifying information in these forums; but apart from warning you to be prudent in your statements, we do not have the ability to keep you from disclosing private facts.

Correspondence with MD SYNERGY. You may use our site to ask questions or report problems regarding our products or site to MD SYNERGY. If you communicate with or request information from our personnel, they will have your email address as well as whatever health-related and/or personal facts you chose to include in your email. If you are reporting a product experience, we may ask you for specific facts, including patient initials, age, and gender, and prescribing physician.

Information that is routinely collected by our site’s technology:

IP Address. We record the Internet Protocol (IP) address of your computer when you visit our site. Without more, the IP address does not identify you personally but it is what allows us to maintain communications with you as you move about our site.

Cookies. MD SYNERGY also collects information about your use of our site through cookies and similar technology. A “cookie” is a unique numeric code that we transfer to your computer so that we can keep track of your interests and preferences and recognize you as a return visitor to our site. Cookie technology allows us to collect “clickstream” data, which is not personally identifying information, but which reflects your activities on the site, including your interest in certain health care conditions. A cookie does not collect or keep your name or other personal identifying information, but when you revisit our site the cookie allows us to bring you the content and features likely to be of greatest interest to you based on your previous activities on our site.

MD SYNERGY may use third-party advertising companies to serve ads on this web site and other web sites. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other web sites in order to measure advertising effectiveness and to provide advertisements about goods and services of interest to you.

II. How We Use Your Information

Whether you are a registered user or a visitor, we use the information about your use of the services and activities on our websites to monitor user traffic patterns and try to analyze what you prefer so that we can design better services for you. The personally identifying information and P.H.I. that you provide may be used to create customized offers, information, and services tailored to your interests and preferences.

Under no circumstances will MD Synergy sell, distribute or otherwise release to any third parties, Protected Health Information which uniquely or specifically identifies the health care provider and/or their specific patients. It is, however, possible that MD Synergy will sell, distribute or otherwise release to third parties, Trend Reporting of Aggregate Data and we specifically reserve the right to do so. Moreover, MD SYNERGY will take all steps reasonably necessary to ensure compliance in all material respects with HIPAA.

Protected Health Information (P.H.I.). If you choose to register on our site, we will collect the information you may choose to disclose and analyze it to discover new facts that could help us better understand how our products are used. We may offer interactive services such as health questionnaires and care management tools that ask you to furnish health-related information about you, your family and/or your patients. The information you disclose and provide in interactive services may be linked with the personal identifying information you may choose to provide elsewhere on our site to provide us with personally identifying information about health and health care. We may combine your P.H.I. with that from other site users to create summary data that we will use for our business purposes, including research to improve our products and analyses that may help us better market our products.

Data Mining, Data Trending & Data Analysis. In the normal course of our business, we routinely conduct data mining, data trending and data analysis with the personally identifying information, the P.H.I., Patient and Physician Demographics, Insurance Demographics, Claims Data and/or Physician Practice Patterns.

Trend Reporting of Aggregate Data. Trend Reporting of Aggregate Data is the process of collecting (via data mining, data trending and data analysis) aggregate data from the personally identifying information, the P.H.I., Patient and Physician Demographics, Insurance Demographics, Claims Data and/or Physician Practice Patterns, and preparing various types of reports on trends found.

Product and Website Reports. If you contact MD SYNERGY regarding your experience in using one of our products and/or our website, we may use the information you provide in submitting reports as may be required of us by law. We also may use the information to contact the registered user to follow up regarding use of our product and/or website.

IP Address. In addition to using the Internet Protocol (IP) address of your computer to maintain communications with you as you move about our site, we also may use your IP address to personalize content provided on the web site. We will retain IP addresses, and we retain them together with personally identifying information.

Cookies. MD SYNERGY uses the data we obtain through the use of cookies to customize your site experience by anticipating the information and services that may be of interest to you. We also analyze the information collected with cookie technology to help us improve the functioning of our site by monitoring traffic in popular areas and to modify the services and information we provide to meet customer demand. We will link the “clickstream” data available to us through the use of cookies to the personally identifiable information and P.H.I. that you may choose to provide elsewhere on our site. We use the information we collect through the use of cookies for our business purposes (i.e. data mining, data trending, data analysis and trend reporting of aggregate data as set forth above), including operation of our site, as well as research and product analyses to help us better market our products.

Law Enforcement. In certain limited circumstances, MD SYNERGY may be called upon to release your personal information in response to a court order, subpoena, search warrant, law, or regulation. MD SYNERGY plans to cooperate in responding to such requests, taking appropriate measures to ensure that the requester understands the sensitive nature of the personally identifiable information and P.H.I. that they may receive. MD SYNERGY also reserves the right to cooperate with law enforcement authorities in investigating and prosecuting users who violate our rules or engage in behavior that is illegal or harmful to other MD SYNERGY users or to any member of the public.

Credit Card Information. We may request credit card information from those desiring to register for use of our site and products. As part of this process a user must provide contact information (like name and billing address) and financial information (like credit card number and expiration date). This information is used for billing purposes. This contact information is used to authorize the charge and, if necessary, to contact the user if we have trouble processing a request, confirming transactions and/or collecting unpaid accounts.

Sharing. We will share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person. We use an outside credit card processing company to bill users for services. We have been advised that this company does not retain, share, store or use personally identifiable information for any secondary purposes. We may partner with other parties to provide other specific services. When the user signs up for these services, we will share names, or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information and/or P.H.I., except for the purpose of providing these services.

Ownership of Information. All information collected by MD SYNERGY (via data mining, data trending and data analysis) of aggregate data from the personally identifying information, the P.H.I., Patient and Physician Demographics, Insurance Demographics, Claims Data, Physician Practice Patterns and/or Trend Reporting of Aggregate Data, is owned exclusively by MD SYNERGY and MD SYNERGY reserves the right at any time and for any purpose to sell, transfer or otherwise dispose of such information.

III. Our Relationship to Third Parties

MD SYNERGY may use third parties to provide services and information on our site, and we may provide some co-branded services in partnership with others. We also may use third parties to analyze data collected on our site. We will not disclose your personally identifying information or P.H.I. to anyone other than MD SYNERGY employees and those third parties with whom we have a business relationship. If we allow a third party contractor to have access to your personally identifying information and/or P.H.I, we will not authorize them to take it or use it for any purpose that is not consistent with this privacy policy.

Cookies. MD SYNERGY does not allow other sites or third parties to use our cookies for their own purposes or to place their own cookies on your computer when you access services through our site.

Vendors and Suppliers. MD SYNERGY has relationships with different vendors and suppliers who help us design and maintain our systems and our computer security, respond to email and customer inquiries, and create special promotions. We may authorize our vendors and suppliers to use our registered users’ personally identifying information for any purpose that is consistent with this privacy policy, even if not related to MD SYNERGY business.

Co-Branded Sites. MD SYNERGY will partner with other companies to provide you with content or services on a joint or “co-branded” basis. At a co-branded site you will see both the MD SYNERGY® logo and the logo of the co-branded partner displayed on your screen. To access the services available on a co-branded site you may have to complete a new on-line registration form, and this registration information may be shared with MD SYNERGY’s co-branded partners. You should read the individual privacy policies of our co-branded partners, as these may differ in some respects from ours. Reading these policies will help you to make an informed decision about whether to provide your information to a given site. Remember, you may always opt-out of sharing your information with a partner site by choosing not to use the service or content provided by the co-branded site.

Links to Other Sites. MD SYNERGY may also feature links to web sites that we believe you might find useful and informative. Please be aware, however, that MD SYNERGY does not endorse or recommend these sites’ content or services, and MD SYNERGY is not responsible for the privacy practices of these other sites. We encourage you to be aware of and read the privacy policy of each site you visit. Remember, the statements in this privacy policy apply solely to information collected by MD SYNERGY.

Advertisers. MD SYNERGY does not permit advertisers to display their advertisements at our site, and we will not permit third party ad servers to use cookies to collect information from users at our site.

IV. Your Privacy Choices

When you access any interactive tool or service on the MD SYNERGY® website, you will be asked to affirmatively choose (“opt-in”) to provide the requested information. You may always choose not to provide the requested information.

When you register with our site, you will be given the option of receiving email with information that we think you might find useful, including promotions, announcements of new services and products, and newsletters on particular health topics. If you decide, at any later time, that you no longer wish to receive these emails you may unsubscribe to our email list by sending an email entitled Unsubscribe to support@mdsynergy.com.

Accept Cookies. Your browser software can be set to reject all cookies, but if you reject our cookies certain of the functions and conveniences of our site may not work properly. Cookies and similar technologies are how we ensure that we can promptly retrieve and deliver the information to you when you use our site.

Deletion Policy. The information that you provide MD SYNERGY is stored in servers that are operated and maintained by MD SYNERGY and third parties under contract with MD SYNERGY. MD SYNERGY® site users should be aware that it is not technologically possible to remove from our servers each and every record of the information you have provided to MD SYNERGY. The need to back-up our systems to protect information from inadvertent loss means that a copy of information about our visitors, registered users and their patients may exist in a non-erasable form that will be difficult or impossible for us to locate. Moreover, it is the policy of MD SYNERGY to routinely archive the entire database which will result in older information being stored off-site for the purposes of keeping the data safe/secure. Accordingly, MD SYNERGY cannot and will not under any circumstances delete any personal identifying information and/or P.H.I. stored in its database.

Communicate with MD SYNERGY by Email. At our Web site visitors and/or registered users may communicate with our staff to learn more about our products and services. Please be aware of the limits on the confidentiality of these email communications. MD SYNERGY will not disclose personally identifiable information and/or P.H.I. that we receive in email, but all email transmissions are vulnerable to unauthorized interception. In addition, we remind you that email sent or received through an employer’s computer or computer system is not confidential and may be the legal property of the employer. Moreover, any time a registered user makes a request for assistance (whether for technological support, to assist in updating, modifying, or otherwise altering any information contained in or regarding a registered users account) via e-mail, or by any other means, such registered user gives explicit consent to allow MD SYNERGY to access the registered user’s account and update, modify, alter any information contained therein, or otherwise comply with the registered user’s request, pursuant to and strictly in according with such request.

V. Our Security Measures

MD SYNERGY wants your personal information to remain as secure as reasonably possible. Our success at improving our products and services depends upon your willingness to share information about your personal health and health care with our researchers.

Data Security. MD SYNERGY uses encryption technology practices to help insure the integrity and privacy of some of the personal identifying information and P.H.I. you provided to us. As an added security precaution, all personal identifying information and/or P.H.I. is kept physically behind firewalls that meet or exceed industry standards to prevent intruders from gaining access. Although we will make reasonable efforts to protect personal identifying information and/or P.H.I. from loss, misuse, or alteration by third parties, you should be aware that there is always some risk that an unauthorized third party could intercept an Internet transmission, or that thieves will find a way to thwart our security systems.

VI. Changes in Our Privacy Policy

MD SYNERGY will only use personal identifying information and P.H.I. in the manner described in the Privacy Policy in effect when the information was collected from you. However, we reserve the right to change the terms of this Privacy Policy at any time by posting revisions to our site. If at any point, we decide to use personally identifiable information and/or P.H.I. in a manner different from that stated at the time it was collected, we will notify users by email to the extent that we have your email address. You will be given the choice at that time to “opt-in” for any additional uses or disclosures of personally identifiable information and/or P.H.I. that you made available to us prior to the change in our policy.
